San Jose police said Wednesday morning that a deadly shooting killed one person, but a 16-year-old was not shot - despite earlier accounts that he was.
Sgt. Heather Randol said in an email that "it was determined after medical examination that the second victim...received minor lacerations while trying to escape from the apartment." He is a minor and has been treated and released from the hospital.
Still, one man was killed about 5:15 p.m. Tuesday when officers responded to a report of shots fired near Almaden Expressway and Coleman Road. When officers arrived, they found a man shot and killed inside an apartment. He was the city's 31st homicide victim this year.
The suspect or suspects remain at large.
Police are not releasing the deceased's identity pending confirmation by the Santa Clara medical examiner's office and notification of his next of kin, Randol said.
